PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

a. The evidence of record shows that on 23 June 1998, a Medical Retention Board (MMRB) met and evaluated the abilities of the applicant to perform the physical requirements of her PMOS 52C10. Based on a thorough review of her most recent permanent physical profile and all other permanent records and reports the medical retention board determined that she be retained in her current PMOS. . Her permanent medical condition does not preclude satisfactory performance of the PMOS physical requirements in a worldwide field environment. The separation authority approved the findings and recommendations of the MOS/Medical Retention Board and directed that the applicant be retained and utilized in her current PMOS, 52C10. The record is void of the facts and circumstances leading to her discharge. On 29 March 2000, Orders 089-002 discharged the applicant from the Regular Army, effective date 25 May 2000.

         b. On 25 May 2000, the applicant was discharged. At the of discharge, the applicant had completed 1 year, 6 months, and 16 days active military service in the period under review and had a total of 3 years, 9 months, and 12 days of military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-40 governs the evaluation for physical fitness of soldiers who may be unfit to perform their military duties because of a physical disability. Chapter 4, provides for the separation of enlisted soldiers found to be unfit by a Physical Evaluation Board (PEB) due to a condition which occurred in line of duty and not due do to the soldier’s misconduct. Paragraph 4-24b(3) provides that soldiers not having sufficient time in service for retirement would be separated by reason of disability with severance pay. The characterization of service for soldiers separated under the provisions of Chapter 4, AR 635-40 will normally be honorable unless the soldier is in an entry-level status. The service of soldiers in an entry-level status will be uncharacterized. A soldier is in an entry-level status if the soldier has not completed more than 180 days of creditable continuous active duty prior to the initiation of separation action.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The applicant’s record is incomplete and does not contain all of the facts and circumstances leading to her discharge from the Army. The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant’s signature. Notwithstanding the fact that the applicant’s pre-induction physical examination and report of medical history may not have revealed that the applicant had an asthmatic condition, the evidence of record shows the applicant was honorably discharged under the provisions of Chapter 4, AR 635-40, by reason of disability, existed prior to service-Physical Evaluation Board (PEB). In the absence of evidence to the contrary, the Board presumed Government regularity in the discharge process. The Board, being convinced that the reason for discharge was both proper and equitable, voted to deny relief.

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
